Arbitrating Commission Disputes

CBA provides a non-judicial process to settle commission disputes between members. Members must submit their disputes over commissions to CBA for binding arbitration. A panel of their peers is convened to hear testimony from both sides, and to make a decision based on the facts of the case in light of the standards of practice in the industry. Decisions of the Arbitration Panel are binding. If a member feels that the process was unfair or biased, they may appeal the decision to the Board of Directors of CBA, and then to the Court. Members may not institute legal action regarding a commission dispute without prior approval of the Board of Directors. The Court will hear an appeal of an Arbitration decision, but will reverse it only if there is a clear violation of the Arbitration Rules or process that was carried out, or if there is new information that was unavailable at the time of the hearing that may influence the outcome of the panel's decision.
